Workers’ compensation appeals take place in several courts

Either party has 20 days to appeal the ruling, and repeated appeals may take the case as far as the Illinois Supreme Court. However, this is very rare. If a workers’ comp appeal in Illinois goes past the arbitration stage, it may go through the following different hearings:

  • Commissioner’s appeal. If you are unhappy with the decision made by the arbitration judge in your workers’ comp case, we may appeal to the Illinois Workers’ Compensation Commission. At the hearing, a panel of three commissioners hears the case.
  • Circuit court appeal. If the commission’s decision is not acceptable to you, we can appeal to the Illinois circuit court in the county where the injury took place. The standard of review in this type of case is higher because the party making the appeal must prove that the commission made the wrong decision, despite the evidence presented.
  • Appellate court appeal. You have the right to appeal a circuit court decision with the Illinois Workers’ Compensation Commission Division of the Illinois Appellate Court.
